Millersburg town marshal accused of stealing woman's panties

A northern Indiana town marshal is facing two misdemeanor counts for allegedly stealing panties belonging to his son's live-in girlfriend.
Police charged 59-year-old Millersburg Marshal David Keith Hathaway Wednesday with two misdemeanor counts of criminal conversion. Messages seeking comment were left by The Associated Press for Hathaway at his office and home on Friday.
A probable cause affidavit states the woman and Hathaway's son set up a hidden video camera that showed Hathaway entering their room and sniffing one panty and stealing another. She also says she found another of her panties in Hathaway's safe.
An initial hearing is scheduled for Aug. 15.
A message seeking information about Hathaway's status as town marshal was left Friday by The AP for town council President Jim Winkler.
The following is a release from the State of Indiana:
The Elkhart County Prosecuting Attorney charged David Keith Hathaway, 59, the Marshal of Millersburg, Indiana, with two counts of criminal Conversion, a Class A misdemeanor, in Elkhart Superior Court 6, today; and, a summons will be issued by the Court for his appearance. Conversion is the crime of exerting “unauthorized” control over property of another person.

The Indiana State Police Investigation determined that in October, 2013, and again in February, 2014, Hathaway maintained unauthorized possession of women’s underwear belonging to another, and for an unauthorized purpose. The Office of the Prosecuting Attorney has notified the Millersburg Town Council of the filing of charges.
Conversion is punishable by up to one year in jail, and a fine up to $5000.
