Speed Radar guns would not be used as evidence to charge reckless driving and reckless endangerment on the roads, the Traffic Police Headquarters announced today.

A determination issued by Attorney General (MTA 601/2009) dated July 3, 2009 directed the Police that the speed guns should be used to prosecute the drivers who broke speed limits and who violated the section 151(2) of the Motor Traffic Act.

However, the traffic Police HQ announced that the Attorney General had decided to cancel his previous Circular (M.T.A. 601/2009) as it was difficult to fully implement due to insufficient legal provisions.

Meanwhile, the Police maintained that offences relating to reckless driving and reckless endangerment would be prosecuted in accordance with the said section 151(2) of the Motor Traffic Act.

The Supreme Court in a 2008 ruling ordered that much visible sign boards of speed limits be put on prior to the implementation of the law.

However, the Road Development Authority has not so far officially informed the Supreme Court that it had fully implemented that SC order. (Lakmal Sooriyagoda)
